New HUD Guidance on ESA's and CARES Act's Update

As of May 2026, HUD has issued new guidance affecting Emotional Support Animals (ESAs), including changes to how animal-related reasonable accommodation requests may be evaluated and enforced under the Fair Housing Act. This class will review the latest HUD guidance, discuss its practical implications for housing providers, and explore best practices for handling assistance-animal accommodation requests.
In a unanimous decision issued on June 12, 2026, the Arizona Court of Appeals held that the CARES Act's 30-day notice provision was tied to the temporary federal eviction moratorium and does not continue to apply to current nonpayment cases. The Court concluded that the notice requirement only applied to rent delinquencies that occurred during the CARES Act moratorium period and expired along with that temporary federal protection.
